Getting Disablity

Is anyone getting disability for having trijeminal nerve? I got it right after episode of Bells Palsy and have been out of work since oct of 2010 . I was turned down for STD and also LTD from my job. I went back in Dec of 2011 but only worked 6 days because I was in collections and had a headset on 8 to 9hrs a day. It hurts to talk so my Dr. gave me a note saying I could not talk for more then 1 hour a day and that I could have 4 episodes a month lasting 3 to 4 days at a time. As you all know that is true except my pain never goes away. I have constant throbbing and pressure around eyes, and sinus area along with numbness. I get a sharp piercing pain in my ear that goes across my cheek. Well they said they could not accommodate me and sent me home with a sixty day job search to find a different position in the company. Their reason was because I would have to miss to much time there really was nothing for me to do. I applied for social security disablity and was denied. Does anyone know what I need to do to get disiability.

Take all of you medical documentation and see a lawyer that specialies in SS Disability. Watch your timing. You have only a short period of time to appeal the first denial. I was denied twice and went before the Administrative Law Judge and was approved. Remember you must include everything that is wrong, I would not have been approved for the ATN as a stand alone, it was all of my other medical problems with the ATN that got it approved.

Good Luck and remember that this process could take up to 2 years. I was lucky and it only took 15 months.

Daisy, I was denied SS because at the time I was working 8 hours a week… I have slowly increased my hours up to 24/week now. And believe me it is a challenge. I wrote a letter to the Human Resources department explaining my disability and stating that I know my rights under the Disability Act. I asked that reasonable accomodations be made for me. The normal shifts at the hospital are 12 hours which is literally impossible for me. But, 8 hour shifts I can get through. I explained that this would not cause any hardship to the hospital. After I wrote the letter I was immediately given a part time position with 8 hour shifts and benefits which I desperately needed to pay for meds. I thought I would never work again at one point but, through the grace of God I am…its not full time like I once did but, I am able to help my family and keep the insurance!!

Thanks Jerry I did get denied but going to attorney on Thursday. I have constant pain with my tn as well as the shooting pains and of course there is depression. I cannot hardly stand to look at a computer screen like I used to and trying to read is hard for me to and when I do I just dont comprehend things like I used to. I hope this works because I cant even get insurance now other then cobra due to pre-exhisting condition.

i live in england i applyed for disabilty over here they sent me back a letter and told me if i can walk and go to toilet with no aid then ur not disabled so thats why i dident get it now i have to work 48 hours a week in between pain and keeping house and family is so very hard on me so if any one from england can get it will they please let me no so i can try aguin thanks lorraine

First, I would like to add... SS denies almost EVERYONE when you first apply. It is just what they do. Don't be discouraged by this.

Then, you do need to get an attorney (who will likely NOT charge you) to pursue the claim. The SS administration doesn't make it easy. I you have been off of work for more than 5 months, you should have no problems getting it right away, but it may be a process. You'll have to get a letter from your doctor to your attorney to get to SS.

I'm also from England and I am having to attend a hearing soon to see if my job will be kept open for me so i need to look into the disability stuff a little more myself. Did you apply to see if you're covered by the DDA and if so how did you get on with it?

hi ya mandy it was a big form i had to fill in could you tell me what the dda is and i will look into that there not very good at letting me no what iam intitled to in wales they seem to think if you can walk then there is nothing wrong with you but when i get this god forseken pain i can hardley move thanks x

Hi Lorraine, it’s the Disability Discrimination Act. If you’re covered by them I think you are better covered when in employment as employees have to make various allowances! I’m not sure if it helps towards a claim for DLA but it may well do! Let me know how you get on with x
