I went to a doctor who told me to put a crown on tooth 14 as soon as he found I have $2000 available for a single month. (since my insurance was changing next month). He prepared the tooth for Crown. when he gave the shots, I had a sparking electrifying pain. I think that when he set me up for TN2. I had pain ever since. I did root canal, retreatment, then I extracted the tooth. All in vain. Then I did panaormic x-ray and found s cyst above the extracted sites. Few ENT and oral surgeon said the cyst is causing the pain others said TN2. to eliminate the possibility I also did sinus surgery to remove the cyst. but the pain continued. finally I was confirmed with TN2. my life had been hail since 6 months. My question is can I sue the Dentist. I was all good before I saw him like a normal person?
Can you sue? Almost anyone can file a lawsuit against anyone. Would you prevail? I'd suggest that it's probably a steep uphill battle, even if your state has few limitations on medical malpractice claims. First of all, you have to prove the malpractice aspect. In other words, the dentist performed work that he either wasn't sufficiently trained to perform or he performed it in a substandard manner. Secondly, you would have to prove that the dental treatment did, in fact, cause your TN.
Having TN is horrible, as we all know, but unless you don't have the funds to pay for your treatment of TN I'm not sure what the benefit of a malpractice lawsuit would be for you even if you prevailed. It isn't going to make the pain go away. But if you really want to explore legal options, I would suggest contacting an attorney who specializes in medical malpractice to discuss your options.
I had a dentist tell me AFTER I had gotten tn2 he wanted to do s novacaine injection in the back of my mouth " to see if when I was numb my pain goes away" well when he injected me I felt the exact same electrical zap you speak of. It set my pain back ten steps. I had to increase all mymedications. He immediatly went into denial mode and said those zaps with injections are common!!! NO THEY ARE NOT. YOU HIT MYNERVE . When it happened to you what did the dentist say??
Well that was the first time. Though I felt something different than normal, I couldn't know he gave the shots on nerve. Neither I had any knowledge of TN or TN2. That's from where my pain started.
Yes I did sue my dentist and only because he wouldn’t say sorry…if he had admitted he had done me harm I would have accepted that.I didn’t want anyone else to suffer as I had and since sueing he has changed his procedures .
How did you sue the Dentist. How did you prove he did the mistake. I spoke to couple of lawyer in Southern California regarding the case. They all told me they will not handle this type case. or i don't have a case. I have already spent 4 thousand dollars from pocket and roaming around doctors to doctors and also did a surgery to elliminate the possibility of not having ATN. And the dentist is still enjoying his life where my life is devastated. I can't take it.
Swayam and Jeff,I live in the UK and here we have certain lawyers who will take on your case in a " no win,no fee"situation…the lawyer takes the risk that if he loses he will lose money,but if he wins he takes 2/3 s of the money paid out.Of course the huge sums of money paid out if the client wins a case in the US is not the same as in the UK…the winning client gets very little considering the life change he/ she has after the injury.And the dentists have huge insurances so the money I received made a small dip into my dentists finances.Never mind, as I said, the amount of the payback was never my aim,it was to get the dentist to be very aware of what he had done.The procedures he changed are too long to go into here Jeff but it involved the way he did implant procedures.And yes swayam I can emphasize your frustration of seeing your dentist enjoying his happy life …I regularly walk past the street in London where my dentist practises and it is unnerving .But try not to let his lifestyle bother you as it only adds negativity to your already difficult life and zaps your energy.I wish you both well.
